terms of service

the rules for using onlyup, including the risks you take on. please read them before you trade.

1. agreement

  • these terms are an agreement between you and onlyup ("onlyup", "we", "us") about using the onlyup website and app (the "service").
  • by using the service, signing in or connecting a wallet, you agree to these terms and to our privacy policy. if you don't agree, don't use the service.

2. eligibility

  • you must be at least 18 years old, or the age of majority where you live if that's higher.
  • games of chance, crypto assets and tokens are restricted or illegal in some places. you are responsible for making sure your use of the service is legal where you are.
  • we may restrict or end access to the service, or to certain features, where the law requires it.

3. what onlyup is

  • onlyup is an interface to smart contracts on robinhood chain. cards are tokens created on the pons launchpad, and onlyup's own contracts handle fees, pots, golden cards, packs, rewards and the vault.
  • the service is non-custodial. we never hold your crypto assets or your private keys. transactions are signed by your wallet and settled on the blockchain.
  • we don't control robinhood chain, pons, uniswap, bridges, wallets or other third-party protocols, and we aren't responsible for them.
  • anyone can interact with the smart contracts directly, without the onlyup website.

4. accounts and wallets

  • you sign in with x, and that is the only way in. we use it only to confirm your identity and never post for you.
  • to trade and use most features, you must connect a wallet. you can link up to 3 wallets to your account.
  • one person may have one account. you are responsible for everything done with your account and your wallets, and for keeping your keys and devices secure. we can't recover lost keys or reverse transactions.

5. cards and creators

  • anyone signed in can launch a card for any public x account, including accounts they don't own. each x account can have one card, and the first launch wins.
  • a card launched by someone else is not endorsed by the person behind that x account until they claim it. launching it doesn't make you their representative or partner.
  • if you launch a card for someone else, you get 10% of the creator's cut of its trading fees and the person gets 90%. that share can't be taken away from you: in the contract the split that pays launchers can only be switched on, never off. all other creator income from the card goes to the person. you can't buy it at launch, and you control nothing about its identity: the tagline, stickers and perks belong to the verified owner.
  • the person behind an x account claims their card by signing in with that account and verifying. until they verify, each amount of their creator share expires after 14 days and goes to onlyup. when they verify, anything already older than 14 days has gone; after that, nothing expires.
  • the person behind the x account can opt out as soon as they sign in with it, without connecting a wallet: the card is hidden on onlyup, all future creator shares (theirs and the launcher's) stop reaching them - eth to the $ONLYUP buyback, $ONLYUP to the season prize pool - and fees already accrued stay claimable. the owner can reverse an opt-out, which only changes shares from then on. we also take cards down on valid requests sent through onlyup's official channels. the token itself stays on the blockchain.
  • by launching a card, you confirm you're not using it to impersonate, harass or mislead anyone, and that nothing you add to it infringes anyone's rights.
  • profile text from x - display names, bios and taglines - is filtered before we show it. we may shorten it, hide words we don't publish, or hide it entirely.
  • a card's fee settings are fixed on-chain at launch and can't be changed. once launched, a token exists on the blockchain and can't be deleted. we may hide a card, or parts of its content, in the onlyup interface if it breaks these terms.
  • creator fees accrue to the creator wallet and can be claimed there. changing the creator wallet after launch takes 72 hours.
  • launching your own card costs pons's launch fee (currently 0.0005 ETH, set by pons and read live) plus gas; launching a card for someone else costs that same pons fee plus our 0.001 ETH, plus gas. only an owner launching their own card can buy it at launch; that buy is optional and capped, and those tokens stay locked for 7 days.

6. fees

  • every buy and sell of a card costs 3%, split between the card's creator, the $ONLYUP buyback, the pots, player rewards, pons and onlyup. trading $ONLYUP costs 1.5%. packs carry an extra 3% pack fee unless your vault tier waives it.
  • you also pay network gas for your transactions.
  • fee rates and splits are described in the docs. some parameters can change within limits enforced by the smart contracts, after a public delay. fees locked into a card at launch never change.

7. games of chance, rewards and prizes

  • the daily pot, mega pot, pump hour, spins, packs and golden cards involve chance or competition. no outcome is guaranteed, and past results say nothing about future results.
  • no purchase necessary: you can get a free daily pot ticket by checking in, without buying anything.
  • prizes and rewards are paid only from the pools and rules described in the docs. a prize that isn't claimed within its claim window goes back to its pot. a draw that can't be completed is cancelled, and its prize money rolls over into the pot.
  • points, tickets, spins, levels, streaks and stickers have no monetary value, can't be sold or transferred, and may change as the service evolves.
  • we may withhold, cancel or reverse rewards, prizes, points or tickets that were obtained through abuse, including wash trading, self-trading, multiple accounts, bots, exploits or any breach of these terms. large payouts may be reviewed before they're released.

8. the $ONLYUP token

  • $ONLYUP is a token used inside onlyup. holding or staking it can unlock perks, and it can be burned for extras.
  • $ONLYUP gives you no ownership, equity, dividends, profit share, voting rights or any claim against onlyup. buybacks and burns follow smart contract rules and are not a promise of any price or value.
  • the team received no $ONLYUP allocation. nothing we say about $ONLYUP is an offer to sell securities or investment advice.

9. risks

  • you can lose everything. cards and $ONLYUP are highly volatile crypto assets. their prices can fall to zero, and a bonding curve means late buyers can lose a lot when others sell.
  • "onlyup" is a name, not a promise. prices go down as well as up. nothing on the service is a guarantee, recommendation or promise of profit.
  • not advice. nothing on the service is investment, financial, legal or tax advice. make your own decisions and get independent advice if you need it.
  • smart contract risk. smart contracts can contain bugs or be exploited, and funds held in or passing through them can be lost. contracts may not be audited, and an audit doesn't guarantee safety.
  • third-party risk. robinhood chain, pons, uniswap, bridges, wallets, oracles and rpc providers can fail, change, pause or be attacked. for example, the pons protocol can change a token's fee recipient after a delay under its own rules.
  • liquidity risk. you may not be able to sell a card when you want to, or at the price you expect. price impact can be large.
  • data delays. prices, balances, timers, pots and leaderboards shown in the app come from our indexer and public infrastructure, and can be delayed or wrong. the blockchain is the source of truth.
  • irreversible transactions. blockchain transactions can't be undone. sending to a wrong address or network can mean permanent loss.
  • anti-snipe tax. buys in the first seconds after a card launches can lose up to 99% of their value to the pons anti-snipe tax.
  • regulatory risk. laws about crypto assets, tokens and games of chance can change and may limit or end your access to the service or to certain features.
  • tax. you are responsible for any taxes that apply to your trades, rewards and prizes.
  • security. scammers may impersonate onlyup. we will never ask for your seed phrase or private keys.

10. no refunds

  • trades, launch fees, steals, stakes, burns and network gas can't be refunded. we can't reverse on-chain transactions.
  • the only refund path is for packs: if a pack isn't filled within the refund window, you can refund it through the smart contract, including the pack fee.

11. prohibited use

you agree not to:

  • break any law or regulation.
  • manipulate markets, including wash trading, spoofing or coordinated schemes to mislead other users.
  • create or control multiple accounts, run sybil schemes, or use bots or automation to farm rewards, tickets, spins or points.
  • exploit bugs, attack or overload the service or the smart contracts, or interfere with other users.
  • impersonate any person or brand, or present a card you launched for someone else as endorsed by them.
  • post content that is illegal, hateful, harassing, sexually explicit, or that infringes someone else's rights.
  • scrape, copy or resell the service except as the law allows, or use it to build a competing service from our non-public data.

12. content and intellectual property

  • the onlyup name, logo, design, icons, stickers and site content belong to us or our licensors.
  • you keep the rights to content you add, like a card tagline. you give us a worldwide, royalty-free licence to display it as part of the service.
  • x is a trademark of x corp. robinhood and robinhood chain belong to robinhood markets. pons, uniswap and other names belong to their owners. onlyup is not affiliated with, endorsed by or sponsored by any of them.

13. third-party services

  • the service links to and relies on third-party services, including x, robinhood chain, pons, uniswap, bridges and wallets. their own terms and privacy policies apply, and we aren't responsible for them.

14. disclaimers

  • the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
  • we don't guarantee that the service will be uninterrupted, secure, accurate or error-free, or that any feature will stay available.

15. limitation of liability

  • to the maximum extent the law allows, onlyup and its team won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, tokens, data or goodwill, arising from your use of the service.
  • to the maximum extent the law allows, our total liability for any claim relating to the service is limited to the greater of 100 us dollars or the fees you paid to onlyup in the 12 months before the claim.
  • some jurisdictions don't allow certain limitations, so some of these may not apply to you.

16. indemnity

  • you agree to indemnify and hold onlyup and its team harmless from claims, losses and costs, including reasonable legal fees, that come from your use of the service, your content or your breach of these terms or the law.

17. suspension and termination

  • we may suspend or end your access to the interface at any time, especially if you break these terms or if the law requires it. because the service is non-custodial, you keep control of your wallet and tokens, and you can still interact with the smart contracts directly.
  • sections that by their nature should survive termination, including risks, disclaimers, limitation of liability and indemnity, will survive.

18. changes to these terms

  • we may update these terms. we'll post the updated version here and, for material changes, give notice in the app. if you keep using the service after a change, you accept the new terms.
